These Terms of Service (“Terms”) govern your access to and use of the Crushtale mobile application and any related features, content, or services (collectively, the “Services”). By accessing or using the Services, you confirm that you have read, understood, and agreed to these Terms as well as our Privacy Policy. If you do not agree, you must not use the Services.

We may revise these Terms from time to time. When significant updates occur, we will provide notice through the Services or by email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

1. Account Eligibility and Registration

1.1 Age Requirements

You must be at least 13 years old to use the Services. By registering for an account, you confirm that you meet this requirement and that you are not legally required to register as a sex offender in any jurisdiction.

1.2 Account Creation

Some features require account registration. You agree to provide accurate and complete registration information, including a valid username and password. You may also register using approved third-party authentication providers, which are subject to their own terms and privacy policies.

1.3 Account Responsibility

You are responsible for safeguarding your login credentials and all activities that occur under your account. You must notify us immediately of any unauthorized use.

1.4 Account Suspension or Termination

You may request deletion of your account by contacting admin@matrixflux.uk Account deletion is permanent and may result in the loss of stored content.

We reserve the right to suspend or terminate accounts that violate these Terms or that threaten the safety, integrity, or functionality of the Services.

2. Acceptable Use

You agree not to misuse the Services. Prohibited activities include, but are not limited to:

2.1 Illegal or Harmful Content

Posting or distributing content that is unlawful, misleading, defamatory, obscene, pornographic, invasive of privacy, abusive, or otherwise objectionable.

2.2 Impersonation and Unauthorized Access

Pretending to be another person or entity or attempting to gain unauthorized access to accounts or systems.

2.3 Harassment and Exploitation

Harassing, threatening, exploiting, or defrauding other users or collecting their personal data without permission.

2.4 Service Interference

Attempting to disable, damage, or bypass security systems, removing proprietary notices, or reverse engineering the Services except where legally permitted.

2.5 Malicious Software

Uploading or distributing viruses, malware, or harmful code.

2.6 Automated Access

Using bots, scrapers, or automated tools to collect or monitor Service content without authorization.

2.7 Circumventing Restrictions

Attempting to bypass access controls, filters, or restricted features.

2.8 Legal Compliance

Using the Services in violation of applicable local, state, federal, or international laws.

3. User Content

3.1 License Grant

When you submit or upload content through the Services (“User Content”), you grant Crushtale a worldwide, non-exclusive, royalty-free, transferable, perpetual, and sublicensable license to host, store, reproduce, adapt, distribute, publish, and display such content for purposes of operating, promoting, and improving the Services.

3.2 User Representations

You represent and warrant that:

- You own or have permission to use the content you upload

- Your content does not violate intellectual property, privacy, or publicity rights

- Your content complies with applicable laws

To the extent permitted by law, you waive moral rights related to submitted content.

3.3 Content Moderation

We may monitor, review, edit, or remove User Content at our discretion, including content that violates these Terms. We do not endorse and are not responsible for User Content.

3.4 Indemnification

You agree to defend, indemnify, and hold harmless Crushtale and its affiliates from claims, damages, or losses resulting from your content or violation of these Terms.

4. Virtual Goods, Subscriptions, and Payments

4.1 Virtual Currency

You may purchase virtual tokens (“Tokens”) for use within the Services. Tokens are licensed digital items with no real-world monetary value and cannot be transferred or refunded except where required by law.

4.2 Payment Processing

- Payments are processed in U.S. dollars unless otherwise stated

- Payments are handled by third-party payment providers

- Consumer rights required by law remain unaffected

- Digital content cancellation rights may be limited after delivery begins

4.3 Subscription Services

- Subscriptions automatically renew unless canceled at least 24 hours before the billing cycle ends

- Subscriptions can be managed through your device’s app store (such as Apple App Store or Google Play Store)

- Free trials and promotional offers may be limited to first-time subscribers

- Subscription pricing or features may change with prior notice

5. Intellectual Property

All rights, title, and interest in the Services, including software, content, graphics, trademarks, and data, are owned by Crushtale or its licensors and are protected by intellectual property laws.

These Terms grant you a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes only.

Notices must comply with the requirements of the Digital Millennium Copyright Act (DMCA) or other applicable laws. Repeat infringers may have their accounts terminated.

7. Disclaimers and Liability Limitations

7.1 Service Availability

The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation and disclaim all warranties except those required by law.

We are not responsible for user-generated content, user behavior, or service interruptions.

7.2 Limitation of Liability

Nothing in these Terms excludes liability for:

- Death or personal injury caused by negligence

- Fraud or fraudulent misrepresentation

- Any liability that cannot legally be limited

To the fullest extent permitted by law, Crushtale shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.

8. Governing Law and Dispute Resolution

8.1 Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

8.2 Jurisdiction

All disputes shall be resolved exclusively in state or federal courts located in Denver, Colorado.

8.3 Informal Resolution

Before filing formal legal claims, you agree to attempt to resolve disputes by contacting us directly. Consumers may retain rights to pursue claims under applicable local laws.

9. Miscellaneous

- These Terms represent the complete agreement between you and Crushtale

- Failure to enforce any provision does not constitute a waiver

- These Terms do not grant rights to third-party beneficiaries

- You may not transfer your rights or obligations without our written consent

- The English version of these Terms controls in case of translation conflicts
